Sandwich franchise sued in fatal pedestrian accident

If you are a fan of Jimmy John’s sandwiches (or at least their commercials) you are likely familiar with their slogan “freaky fast delivery.” It is a niche that has made the sandwich making franchise famous. However, the slogan (and the practice of swift delivery of sandwiches) has come under fire after a lawsuit has been filed by the daughter of a man who was killed when a Jimmy John’s delivery driver struck him.

According to a report by the Pittsburgh Post-Gazette, the man who lived in Morgantown, West Virginia was reportedly walking his dog last summer. The wrongful death suit claims that Jimmy John’s fosters a working environment that encourages unsafe driving that puts the public at risk and led to the man’s death. According to police reports, the driver was allegedly looking at the clock on his dashboard (instead of the road) when he hit the pedestrian.

It remains to be seen whether Jimmy John’s stores in Phoenix will be affected by the lawsuit, but it is a critical reminder of the duty delivery drivers have to use reasonable care when carrying out their duties (no pun intended). While time is of the essence, safety cannot be compromised in light of it. If a driver fails to use such care, and an accident occurs, the offending driver could be held liable for the crash.

This would mean that injured parties could seek compensation for their injuries, including pain and suffering, medical expenses, lost wages and rehabilitative costs. The moral of the story is, “freaky fast” must be super safe.
