Another recall notice for GM vehicles

A number of our posts lately have focused on the issue of auto recalls. This is important for a number of reasons. When a person is injured in a car accident, there could be a number of possible causes. Driver error is one (obvious) reason, but there may be mechanical defects that could have led to the crash. An investigation into the crash could reveal the real culprit, which could actually be the car’s manufacturer.


An automaker has a duty to ensure that the vehicle it sells to an unwitting consumer is free of defects that would put the consumer in harm’s way. When it is notified of a defect, it has a responsibility to correct the problem so that the consumer does not run the risk of being injured in an accident caused by the defect. However, if the automaker fails to correct a problem it has been put on notice about, and the issue leads to an accident, the automaker could be held liable for the ensuring injuries. 

As such, doing an investigation into what a manufacturer knew about, or did to resolve a defect can absolve a driver of his or her liability in a crash.

In the meantime, General Motors has announced another recall. This one will apply to SUVs built between 2008 and 2013. GM says that a problem with the vehicles’ airbag systems prompted the recall. The automaking giant is currently undergoing “intense review” of its recall procedures by the U.S. Justice Department. Sanctions may be levied, and this may lead to additional lawsuits.
