Tracy Morgan and others sue Wal-Mart after semi-truck crash

Comedian and actor Tracy Morgan was released from a rehabilitative center this week and will begin what is called an “aggressive” outpatient rehabilitative program. After he was released, it was announced that he had initiated a lawsuit against Wal-Mart. Morgan’s limousine van was struck from behind by a semi truck owned by Wal-Mart and driven by an employee of the retail giant.

Morgan was seriously injured, and fellow comedian James “Jimmy Mack” McNair was killed. Several others in the van were injured as well. 

Wal-Mart has a duty to the public to ensure that its drivers adhere to safety regulations to ensure that accidents such as these do not occur. If Wal-Mart fails in this duty and such a failure results in a person being injured or killed, the company could be held liable. In his complaint, Morgan explained that Wal-Mart’s actions were “gross, reckless, willful, wanton and intentional.” Because of this, Morgan and the other plaintiffs named in the suit are calling for punitive damages to be ordered by the court.

Wal-Mart reportedly is cooperating with authorities in the investigation of the crash. It was revealed that the driver had been awake from more than 24 hours before the crash, as he had commuted from his home in Georgia to pick up the truck in Delaware.  It was also discovered that the driver was travelling at more than 20 miles over the speed limit in the minutes before the crash occurred.

While the monetary figure for recovery was not revealed, Morgan and the other plaintiffs can seek damages for medical expenses, pain and suffering, lost wages and other costs associated with the damages sought.
